What happens if you miss an off-plan payment in Ras Al Khaimah?
Published 4 November 2026
Data as of 4 November 2026. Law checked against the Arabic text on 2 November 2026.
If you miss an off-plan payment in Ras Al Khaimah, the developer must report it to the regulator, which then gives you 30 days to pay. If you still do not pay, the developer may cancel your contract without going to court and keep up to 40% of the price, depending on how far the building has got, but never more than you have paid.
This answer is part of our guide to off-plan on Al Marjan Island.
The rule
The rules sit in Article 20 of RAK Law No. 10 of 2026 on Regulating Real Estate Development, issued on 21 July 2026 and in force sixty days later (RAK Government legislation portal, Arabic text). The regulator is the Real Estate Regulatory Administration within RAK Municipality.
Step by step
- The developer notifies the regulator on its standard form.
- The regulator checks both your default and the project's actual progress, using the reports it holds.
- You are given 30 days from its notice to meet your obligations.
- If you do not pay, the regulator issues the developer an official document allowing it to cancel the contract on its own.
- The developer may then cancel without court or arbitration, and deduct a share of the contract price. The regulator must approve the amount.
- The balance comes back to you, or is deposited with the Municipality, within six months of cancellation.
On this route, no cancellation can happen until the regulator has checked the file and the 30 days have run.
How much the developer can keep
| Project completion | Maximum deduction from the price |
|---|---|
| 60% or more | 40% |
| Under 60% | 25% |
| Not started, for reasons outside the developer's control | 20% |
The deduction can never be more than you have already paid. On a AED 2m unit at 70% completion, the cap is AED 800,000, but if you had paid AED 400,000, the most the developer could keep is AED 400,000.
Read the other way, the table shows where the risk sits. Early on, the cap is lower, but so is what you have paid. Late on, you have usually paid more and the cap is 40%, so a default near handover usually costs the most.
What the coverage says, and what it leaves out
The Gulf Pulse (Asma Ali Zain, published 9 October 2026, updated 12 October) reports the same three caps: 40% at 60% completion or more, 25% below 60%, and 20% where construction has not started for reasons beyond the developer's control. It also reports the six-month refund, the reach to older contracts and the right to withhold milestone payments. That matches Articles 19 and 20.
Three points in the Arabic text are not in that article, and each matters to a buyer: the 30 days you get to pay before any cancellation, the rule that the deduction never exceeds what you have paid and needs the regulator's approval, and that either side can still go to court or arbitration.
The article also says the previous law had four deduction bands and auction procedures. We have not read Law No. 12 of 2023, so we do not test that here.
Why it matters on Al Marjan Island
Most projects on the island are still being built. In our sample report (data as of 27 September 2026), 63 of 82 tracked projects were under construction and one had not started. Of 72 projects we track with a known delivery date, handovers peak in 2028, with 28 projects (RAK Radar snapshot, 4 November 2026).
For most buyers on the island, then, the cap depends on whether their project has passed 60% completion, the line that moves it from 25% to 40%. Ask the developer for the latest completion percentage reported to the regulator.
One point buyers miss
You may be able to withhold instead. If your payments are tied to construction stages and the developer has not reached the stage due, Article 19 lets you hold back that payment, provided you tell the developer in writing before it falls due. The law treats that as your right, not a default.
